14.10.2026 IN THE HIGH COURT AT CALCUTTA Item No.3 CIRCUIT BENCH AT JALPAIGURI Ct.No.35 CRIMINAL MISCELLANEOUS JURISDICTION dc. Rejected FROM PRINCIPAL BENCH C.R.M. (NDPS) 671 of 2026 In Re : An Application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Dinhata Police Station Case No. 380 of 2026 dated 27.05.2026 under Sections 21(c)/25/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985. And In Re : Bhabesh Barman @ Bharat Chandra Barman ... Petitioner. Mr. Atis Kumar Biswas, Mrs. Jyoti Agarwal ... For the Petitioner. Mr. Avrojyoti Das, APP, Ms. Ruchika Agarwal ... For the State. Learned advocate appearing for the petitioner submits that petitioner was arrested in connection with the instant case on 27.05.2026 and unnecessarily the petitioner has been connected with alleged recovery of 700 bottles of Fairdyl Cough Syrup. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail as investigation of the case is in progress. I have taken into account the case diary and the tenancy agreement of the godown and the seizure primarily reflects that the seizure was effected from the godown itself. Having considered that the investigation of the case is in progress, at this stage, I am not inclined to release the 2 petitioner on bail. As such, the prayer for bail of the petitioner is rejected. The application for bail, being CRM (NDPS) 671 of 2026, is, thus, dismissed. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
