C.S.No.275 of 2025 has been instituted by the first plaintiff Charitable Trust and its trustees under Section 92 of the Code of Civil Procedure, seeking permission of this Court to sell the Trust properties situated at Angappa Naick Street, George Town, Chennai, measuring 2,850 sq.ft. in total, and to utilise the sale proceeds for establishing a madrasa/school in furtherance of the objects of the Trust. 3. During the pendency of the suit, the third plaintiff, Razia Sultana, who was one of the trustees of the first plaintiff Trust, died on 19.12.2025. Thereafter, by resolution dated 01.02.2026, the Board of Trustees co-opted the applicant, Mr Mohamed Imtiaz, as a trustee in her place to ensure continuity of the administration and functioning of the Trust. 2/4 https://www.mhc.tn.gov.in/judis A. The proposed applicant is the successor in the office of trustee; therefore, substitution does not alter the nature or scope of the suit, and no prejudice would be caused to any person by permitting the applicant to come on record as the successor trustee. 5. Accordingly, this application is allowed. 6. The Registry is directed to make the necessary amendment to the cause title.
