GP FOR REGISTRATION AND STAMPS (AP) 4 VS,J W.P.Nos.16110 & 16192 of 2018 The Court made the following: COMMON ORDER: As both these writ petitions are filed by the same petitioner, this Court feels it appropriate to dispose of both these writ petitions by way of a common order. 2. W.P.No.16110 of 2018 came to be filed under Article 226 of the Constitution of India, seeking the following prayer: “…to issue appropriate writ or order or direction more particularly one in the nature of writ of mandamus declaring (i) the action of the respondents 2 and 3 in including the land in Sy.No. 325/2 an extent of Ac.1.92 cents of Konduru Village, Lepkashi Mandal, Anantapur District in the prohibition list under sec.22 -A(1)(a) of Registration Act, 1908 (ii) the action of the 4th respondent in refusing to register the sale deed relating to the land in Sy.No. 325/2 an extent of Ac.0.64 cents of Konduru Village, Lepkashi Mandal, Anantapur District vide refusal order dt-16-05-2017 is illegal, arbitrary and in violation of Principles of Natural justice and in violation of Art.14 of the Constitution of India and consequently direct the 4th respondent to register the sale deed relating to the land in Sy.No. 325/2 anextent of Ac.0.64 cents of Konduru Village, Lepkashi Mandal, Anantapur District in the interest of justice and to pass” 3. W.P.No.16192 of 2018 came to be filed under Article 226 of the Constitution of India, seeking the following prayer: “…to issue appropriate writ or order or direction more particularly one in the nature of writ of mandamus declaring (i) the action of the 5 VS,J W.P.Nos.16110 & 16192 of 2018 respondents 2 and 3 in including the land in Sy.No. 325/2 an extent of Ac.1.92 cents of Konduru Village, Lepkashi Mandal, Anantapur District in the prohibition list under sec.22 -A(1)(a) of Registration Act, 1908 (ii) the action of the 4th respondent in refusing to register the sale deed relating to the land in Sy.No. 325/2 an extent of Ac.0.64 cents of Konduru Village, Lepkashi Niandal, Anantapur District vide refusal order No.86/2017 dt.3-11-2017 is illegal, arbitrary and in violation of Principles of Natural justice and in violation of Art.14 of the Constitution of India and consequently direct the 4th respondent to register the sale deed relating to the land in Sy.No. 325/2 an extent of Ac.0.64 cents of Konduru Village, Lepkashi Mandal, Anantapur District in the interest of justice and to pass” 4. Aggrieved by the action of the respondents in including the land admeasuring Acs.1.92 cents in Sy.No.325/2 situated in Konduru village, Lepakshi mandal, Anantapur district from the prohibition properties list under Section 22 A(1)(a) of Registration Act, 1908, these writ petitions are filed. 5. When these writ petitions came up for hearing on 11.11.2025, it was brought to the notice of this Court that learned counsel for the petitioner is no more, as such, the Registry was directed to issue notice to the petitioner to make alternative arrangements. Though notices were served on the petitioner, no steps were initiated for alternative arrangements. 6. Heard learned Assistant Government Pleader for Revenue. 6 VS,J W.P.Nos.16110 & 16192 of 2018 7. Today, when these matters came up for hearing, learned Assistant Government Pleader has furnished a copy of instructions of the 3rd respondent which were enclosed along with a copy of the proceedings of the Collector and District Magistrate, Ananthapuramu bearing Rc.No.E2/5756/2021, dated 06.03.2022 wherein, basing on recommendations of Sub-Collector, Penukonda and the Tahsildar, Lepakshi mandal, the District Registrar, Hindupur was directed to delete the subject lands from the list of prohibited property lands in accordance to G.O.Ms.No.575, Revenue (Assignment – I) department, dated 16.11.2018. In compliance to the same, the subject properties were deleted from the list of prohibited property lands under Section 22-A(1)(a) and a copy of the deletion list is enclosed. 8. The said instructions would disclose that the subject properties were already deleted from the list of prohibited properties list. As such, this Court is of the opinion that no further cause survives in the present writ petition. 9. In view of the same, these writ petitions are closed. There shall be no order as to costs.
