SUNDAR For petitioner Mr. Wahengbam Jamon Singh, Advocate Date of Judgment & Order 10.06.2026 JUDGMENT AND ORDER (ORAL) 10.06.2026 [1] This order will now dispose of captioned Transfer Petition. [2] In the hearing today, Mr. Wahengbam Jamon Singh, learned counsel on record for transfer petitioner (High Court of Manipur) is before this Court. Page 8 of 20 [3] Instant order has to be read in conjunction with and in continuation of earlier proceedings made by this Court in the listing on 23.03.2026 which reads as follows: ‘23.03.2026 [1] Mr. Kh. Tarunkumar, learned senior counsel instructed by Mr. Rustam, learned counsel for transfer petitioner is before this Court. [2] Mr. Kh. Tarunkumar, learned senior counsel submits that captioned transfer petition has been filed seeking transfer of 44 POCSO (Protection of Children from Sexual Offence) cases now pending on the file of ‘District & Sessions Judge, Thoubal’ (‘transferor Court’ for convenience) to ‘Fast Track Special Court No. 1 at Cheirap Court Complex and Fast Track Special Court No. 2 at Lamphel Court Complex’ (both in Imphal) (‘transferee Courts’ for convenience) [3] Mr. Kh. Tarunkumar, learned senior counsel submits that the transferor court is a regular Court of a learned District Judge which deals with several other civil and criminal cases and it is designated POCSO court but the transferee courts are dedicated/exclusive POCSO courts and are Fast Track Special Courts. [4] Learned senior counsel drawing the attention of this Court to a letter dated 28.10.2025 bearing Reference No. 7/4/2014/DJ(TBL)/2025/1449(a) from learned Presiding Officer of transferor Court to the learned Registrar General of this Court, submits that owing to huge pendency in the transferor court and also owing to transferee courts being exclusive POCSO Courts (Fast Track Special Courts) it is necessary to transfer 44 POCSO cases as mentioned above and adds that such transfer will expedite disposal of these cases. To be noted, the details of the 44 POCSO cases sought to be transferred are as follows: [5] Adverting to the afore-referred letter dated 28.10.2025 from the learned Presiding Officer of the transferor Court, Mr. Kh. Tarunkumar, learned senior counsel, on instructions, submits that consent of the State counsel as well as the accused/learned counsel for accused in all the 44 cases has already been taken, for the transfer that is being sought. [6] However, the captioned matter will now stand over to another date to enable learned counsel for transfer petitioner to do the following: (i) get instructions on why 44 POCSO cases are sought to be transferred leaving out two (to be noted, there are 46 POCSO cases on the file of transferor court even as per list annexed to the afore-referred 28.10.2025 letter from the learned Judicial Officer of the transferor Court; (ii) to produce consent signatures of learned State counsel and learned counsel for accused/accused as regards transfer of the afore-referred 44 cases. [9] List on 30.04.2026.’ [4] Afore-referred earlier proceedings of this Court speaks for itself and therefore, this Court refrains from dilating on the contents again in instant order. Suffice to write that the afore-referred 23.03.2026 proceedings made by this Court in captioned transfer petition shall now be read as an integral part and parcel of instant order. [5] Adverting to afore-referred proceedings made by this Court in the listing of captioned transfer petition on 23.03.2026, Mr. Wahengbam Jamon Singh, learned counsel has placed before this Court a communication dated 29.04.2026 bearing reference No.D&SJ/2026/501 from learned District and Sessions Judge, Thoubal to the Registry of this Court along with an enclosure. To be noted, the enclosure is a tabulation of particulars of POCSO cases containing the consent signature of State counsel as well as counsel for accused. A scanned reproduction of this 29.04.2026 letter and enclosure are as follows: The afore-referred communication and enclosure are self-explanatory /they speak for themselves. Suffice to write that the reason for seeking transfer of only 44 cases while 46 POCSO cases are pending on the file of Transferor Court stands explained (they are at final arguments stage). As regards the 44 POCSO cases which are sought to be transferred the details of which have been set out in a tabulation vide paragraph 4 of afore-referred 23.03.2026 proceedings, two cases will now not be transferred and they are Sl.No. 37 in the tabulation (Special Trial POCSO Case No.1 of 2021 bearing Ref No. FIR No.15(12)2019 WKG. P.S. U/S:366/368/34 IPC & 4 POCSO Act) and Sl. No. 42 being Special Trial POCSO No.09 of 2020 bearing Ref. No. FIR No.12(03)2019 WPS-TBL U/S:366-A/34 IPC & 4 POCSO Act The narration thus far means that 42 cases in the tabulation set out in paragraph 4 of earlier proceedings dated 23.03.2026 namely Sl. Nos.1 to 36, Sl. Nos.38-41 and Sl. Nos.43 & 44 ( 42 cases in all) will now stand transferred from transferor Court to transferee Courts. Page 20 of 20 [6] Out of the afore-referred 42 cases which now stand transferred vide instant order Sl. Nos. 1 to 21 shall stand transferred to Fast Track Special Court No.1 at Cheirap Court Complex, Sl. Nos.22-36, Sl. No.38-41 and Sl. No.43 & 44 (21 cases ) will stand transferred to Fast Track Special Court No.2 at Lamphelpat Court Complex. [7] The two transferee Courts shall now try and dispose of the cases by proceeding from the points at which they stand transferred i.e., from the point at which 42 cases stand today.
