The petitioner has moved this petition under Section 29-A (5) of the Arbitration and Conciliation Act, 1996, seeking extension of period for concluding the arbitration proceedings pending before the Arbitral Tribunal. 02. A brief narration of facts that have led the parties to the current stage is imperative. Arbitration Petition No. 17/2020 moved by the petitioner was allowed by this Court on July 21, 2020 and by virtue of the said order, Mr. Justice Permod Kohli, Retired Chief Justice of Sikkim High Court, was appointed as the Arbitrator. The Arbitral Tribunal entered upon the reference. This Court vide order dated 24.05.2024 passed in CM No. 1947/2024 extended the mandate of the Arbitrator for a period of six months. Subsequently, vide orders dated 13.02.2025 and 22.08.2025 passed in Arb P No.12.2025 and Arb P No. 64/2025, the time was extended by a further period of six months, respectively. It is stated that in order to make an award in the matter, the Arbitral Tribunal requires extension of time by a further period of six months. 03. Concededly, the mandate of the Arbitrator is going to expire on February 15, 2026. 04. As indicated above, the petition at hand, has been moved by the petitioner in terms of sub-section 5 of Section 29-A of the Act for extension of the period specified under sub-section 4 of the Act. 05. Served with an advance copy of the application, Ms. Sagira Jaffer learned counsel present in Court, on instructions, submits that she has no objection in extending the mandate of arbitrator. 06. In the wake of the position indicated above and since the averments set out in the application constitute a sufficient cause, the application is allowed. The mandate of the Arbitrator is accordingly extended by a further period of six months with effect from February 16, 2026, for making an award. 08. Disposed of accordingly.
