BINDU PARAMANIK & ORS. VS THE STATE OF WEST BENGAL & ORS. Mr. Lalratan Mondal ….for the Petitioners
Mr. Rachit Lakhmani, Mr. Vaibhav Prakash ….for the State
1. Affidavit of service filed on behalf of the petitioner is taken on record. 2. The case of the petitioner is that the petitioners are the owner of a landed property situated in LR Dag No.4540 at Mouza – Sindri, JL No.3 under LR Khatian Nos.1422, 1424, 1425 and 1426 measuring about 0.21 acres of land under Purulia (M) Police Station. The private respondents has suddenly started committing illegal and unlawful activities on the said property. Such incident was brought into the notice of the police authority by the petitioners through a letter dated 04.12.2025. 3. The petitioner is aggrieved by inaction on the part of the police station in taking steps in pursuant to the said complaint. 4. The petitioner has prayed for an order that the respondent authorities be directed to look into the
2 complaint dated 04.12.2025 and take appropriate steps in the matter. 5. This Court has considered the submission made by the learned advocate for the petitioner and materials on record available. It appears that the petitioner has informed the commission of cognizable offence to the notice of the Inspector-in-Charge of Purulia (M), Police Station by the said letter dated 04.12.2025. No steps have been taken by the said police authority. 6. The writ petition is disposed of by granting liberty to the petitioner to file appropriate application before the jurisdictional Court to redress the grievances for registration of FIR of the petitioner. This Court is not inclined to pass orders as prayed for, directing the police authorities to register an FIR, as an alternative efficacious remedy is available to the petitioners under BNSS, 2023. Further, the Hon’ble Supreme Court in Sujal Vishwas Attavar and Another vs. State of Maharashtra & Ors., (2026) SCC OnLine SC 798 (para 7) and Om Prakash Ambadkar vs. State of Maharashtra & Ors., (2026) 2 SCC 622 has also categorically held that the above relief cannot be granted in a writ under Article 226 of the Constitution
7. In view of the aforesaid observations, the instant writ petition being WPA 29211 of 2025 is disposed of accordingly without any order as to costs. 3
