CRL MP No. 12205 of 2026 __________ Page2 of 4 PRAYER: Criminal Miscellaneous Petition filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, to relax the condition No.(b) that the petitioner 1,3,4 and 5 shall report before the respondent police daily at 10.30 A.M, and the 2nd petitioner shall report before the respondent Police every Monday at 10.30 a.m., until further orders dated 27.05.2026 made in Crl.O.P.No.13835 of 2026. For Petitioner(s): Mr. V.Elangovan For Respondent(s): MS.R.S.INDIRA, GOVT.ADVOCATE (CRL.SIDE) ORDER This Criminal Miscellaneous Petition has been filed by the petitioner seeking to modify the condition imposed in Crl.OP.No.13835 of 2026 dated
27.05.2026. 2. The learned Government Advocate (Crl.Side) appearing for the respondent Police strongly objected the application, however fairly conceded that petitioners 1, 3, 4 and 5 have been regularly complying with the conditions imposed by this Court, whereas the second petitioner has complied with the condition only for one day. Hence, she prays for the dismissal of the petition as against the second petitioner. 3. Considering the submissions made on either sides and the nature of the offence, this Court is inclined to modify the condition imposed on petitioners 1, 3, 4 and 5 in Para 4 (c) in Crl.OP.No.13835 of 2026 dated 27.05.2026.
Accordingly, the condition that “the petitioners 1, 3, 4 and 5 shall report before the respondent police daily at 10.30 a.m and the second petitioner shall report https://www.mhc.tn.gov.in/judis
CRL MP No. 12205 of 2026 __________ Page3 of 4 before the respondent police every Monday at 10.30 a.m, until further orders” is modified to the effect that “the petitioners 1, 3, 4 and 5 shall report before the respondent police once in a week at 10.30 a.m., until further orders”. Insofar as the second petitioner is concerned, since he has not complied with the condition imposed by this Court, this Court is not inclined to modify the said condition. The other conditions imposed earlier shall remain unaltered. 4. In the result, the conditions imposed by this Court in respect of petitioners 1, 3, 4 and 5 are modified as indicated above. Insofar as the second petitioner is concerned, this Criminal Miscellaneous Petition is dismissed.
