THOTA RAMAKOTESWARA RAO The Court made the following: 3 ORDER: (Per Hon’ble Sri Justice D.Ramesh) I.A.No.01 of 2026 is filed praying the Court to record the compromise between appellant and respondent as per the Terms and conditions as incorporated in the annexed Memorandum of Compromise Term and Conditions dated 15.6.2026. The appeal is filed by the claim petitioner aggrieved by the orders of the II Additional Senior Civil Judge, Vijayawada in E.A.No.83/2017 in E.P.No.9/2016 in O.S.No.1056/2013 dated 20.12.2018. As the petitioner therein is the third party, he filed petition under Order 21 Rule 58 and Section 151 CPC. The said petition was dismissed on that ground that the said transaction is a collusive transaction between respondent no.2 and the claim petitioner. While pending the appeal, the parties have filed the present I.A. to record compromise and close the appeal. In view of the memorandum of conditions filed along with the joint memo in this I.A., this Court is inclined to record the compromise memo except the condition no.C and E in the conditions of Compromise. Accordingly, the appeal suit is closed. No costs.
