HC-KAR NC: 2026:KHC:154 WP No. 23026 of 2022
dated 27.09.2022 in WP.No.9606/2020, what could be seen from the said order is that the Division Bench of this Court in the Public Interest Litigation has recorded the submission of the respondent-BBMP that action would be taken to remove all commercial activities from the residential area. If that be so, it would be for the official respondents to have issued appropriate notices, conduct proceedings as per the applicable law and thereafter, pass necessary orders. There is no particular order which has been passed in WP.No.9606/2020 insofar as the petitioner is concerned.
4. As such, in the above circumstances, I pass the following:
ORDER i) Writ petition is allowed. ii) The
order/notice dated 14.11.2022 issued by respondent No.2 is read down as a Show Cause notice granting liberty to the petitioner to reply to the same within a period of 15 days from the date of receipt of a copy of this order.
