09.10.2026 Court No.758 DL/Item No.–150 [Milan] WPA 29433 2025 HIMANSHU DHARA VS THE STATE OF WEST BENGAL & ORS. Mr. Sushovon Dey, Mr. Subhrajyoti Dey, Mr. Vaskar Saha ….for the Petitioner 1. Affidavit of service filed on behalf of the petitioner is taken on record. 2. The grievance of the petitioner is that despite lodging complaint dated 05.12.2025 before the Inspector-in- Charge, Panskura Police Station, the police authorities have failed and neglected to take steps in the matter. 3. The petitioner claims to be the owner of a property and the private respondents, being son and daughter- in-law of the petitioner, are illegally trying to obstruct the construction work over the land of the petitioner. 4. The petitioner further draws attention of this Court to FIR being Purba Medinipur, Police Station Case no.731 dated 07.08.2025 registered by the police authority regarding the criminal acts committed by the private respondents. 5. The petitioner, therefore, prays for an order that the police authority should provide adequate police protection to the petitioner and restrain the private 2 respondents from doing any illegal activities at the said property. 6. Having heard the parties and submission made by the petitioner, it appears that the petitioner’s grievance can be best redressed in a separately instituted civil suit. 7. The petitioner shall be at liberty to take his grievance before the appropriate forum in accordance with law. 8. With regard to failure of the police to register a case on the basis of the complaint dated 05.12.2025, the petitioner shall be at liberty to approach the jurisdictional Magistrate with an appropriate application under Section 175 of BNNS for registration of FIR. If such application is filed by the petitioner, the same shall be disposed of in accordance with law. 9. In view of the aforesaid observations, the instant writ petition being WPA 29433 of 2025 is disposed of accordingly without any order as to costs. 10. All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court. 11. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities. (Anuj Singh, J.)
