JUSTICE R DEVDAS ORAL ORDER Learned Additional Government Advocate takes notice for respondents No.1 to 4. Notice to the other respondents is not necessary for the following reasons: 2. The petitioner filed an impleading application before the Additional Deputy Commissioner, Bengaluru Urban District, in proceedings bearing Revision Petition No.40/2023 filed by the legal representatives of late Sri Siddagangiah, who were aggrieved of the cancellation of their grant, at the hands of the Assistant Commissioner. 3. Learned Additional Government Advocate, however submits that the impugned order at Annexure ‘A1’, is regarding the revision petition filed by the legal representatives of late Sri Siddagangiah. The application filed by the petitioners herein who sought to implead themselves in the said proceedings were earlier allowed. - 5 - HC-KAR NC: 2026:KHC:299 WP No. 23659 of 2025 4. On hearing the learned counsel for the petitioner and on perusing the petition papers, this Court finds that 4 acres and 10 guntas of land in Sy.No.31 of K.G.Srinivaspura Village, Sompura Hobli, Nelamangala Taluk were granted in favour of Sri Siddagangaiah at the orders passed by the Committee for Regularisation of Unauthorised Occupation on 02.08.2016. However, the Tahsildar, Nelamangala Taluk, filed an appeal invoking Rule 108-K of the Karnataka Land Revenue Rules, contending that the said lands in Sy. No.31 were ‘Sarkari Karabu Halla’, which could not have been granted to any person. The Assistant Commissioner accepted the contention of the Tahsildar and allowed the appeal while cancelling the grant made in favour of Sri Siddagangaiah. After the orders were passed by the Assistant Commissioner, Sri Siddagangaiah died and therefore the legal representatives of Sri Siddagangaiah preferred revision petition before the Additional Deputy Commissioner. - 6 - HC-KAR NC: 2026:KHC:299 WP No. 23659 of 2025 5. Having regard to the facts narrated hereinabove, this Court is of the considered opinion that the petitioner is contending that her name should be entered in the revenue records since the petitioner has succeeded to the property belonging to one Sri Huccha Bhovi and it is the contention of the petitioner that on the death of Sri Huccha Bhovi, since the petitioner has succeeded to the estate of Sri Huccha Bhovi, her name has to be entered in the revenue records. Therefore, in the revision petition filed by Sri Siddagangaiah’s legal representatives who were aggrieved of the cancellation of the grant made in favour of Sri Siddagangaiah, there was no occasion for the petitioner to have filed an application to implead herself in the said proceedings. However it is open for the petitioner to approach the competent authority to seek entry of her name in the revenue records on the strength of her succeeding to the estate of late Sri Huccha Bhovi. 6. Accordingly, the writ petition stands disposed of reserving liberty to the petitioner to approach the - 7 - HC-KAR NC: 2026:KHC:299 WP No. 23659 of 2025 competent authority to seek entry of her name in the revenue records, in accordance with law. Ordered accordingly. Sd/- (R DEVDAS) JUDGE JT/- CT:JL
