GP FOR PANCHAYAT RAJ RURAL DEV The Court made the following: 4 SRK, J WP.No.17467 of 2026 O R D E R This Writ Petition is filed seeking the following relief: “….to issue a writ, order or a direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the Respondent No.2 in not taking any action against the illegal encroachments and unauthorized construction undertaken by unofficial 3rd respondent by illegally closing the Public Bodhi and also occupying the government land by making constructions in the government land in R.S.No.19/1 of Uradallapalem gram panchayat, Attili Mandal, West Godavari District in front of his house in 4th ward, near vinayaka temple, Uradallapalem Gram Panchayat, Attili Mandal despite our representation Dt. 12.06.2026 as illegal, irregular, arbitrary and violation of the provisions of The Andhra Pradesh Panchayat Raj Act, 1994 and Rules framed there under and also offends Articles 14, 21 and 300-A of Constitution of India and consequently direct the 2nd respondent to take action against the unofficial 3rd respondent by removing the illegal encroachments made by him over government land and protect the public bodhi in R.S.No.19/1 and restore the same for communal utility and public sanitation and pass such other order…” 2. Heard learned counsel for the petitioner, learned Assistant Government Pleader for Panchayat Raj and learned Standing Counsel for Gram Panchayat. 3. Case of the petitioners, in brief, is that they are residents of Uradallapalem Village, Attili Mandal, West Godavari District, and members of the Varasiddi Vinayaka Temple Utshava Committee. According to them, the unofficial Respondent No.3, whose house is situated adjacent to the temple, has encroached upon Government land in R.S.No.19/1 by raising unauthorized constructions. It is their case that a Government bodhi (drain) passes from the temple along the eastern side of the house of Respondent No.3 and turns towards the south at its south-eastern corner. The said bodhi carries rainwater and drainage water from the surrounding houses, and there 5 SRK, J WP.No.17467 of 2026 is no alternative drainage channel. The petitioners further alleged that Respondent No.3, while renovating a ground and first-floor building situated in an extent of Ac.0.02 cents in R.S.No.19/1, has illegally laid a slab over the Government bodhi without obtaining the requisite permissions, with the support of the respondent authorities. Aggrieved by the inaction of Respondent No.2 in taking action against the alleged encroachment, the petitioners have filed the present Writ Petition. 4. Today, when the matter is taken up for hearing, the learned Standing Counsel for the Gram Panchayat, on written instructions, submits that Respondent No.3 has not undertaken any construction on the bodhi land. It is further submitted that, upon inspection, Respondent No.2 found that Respondent No.3 has neither encroached upon Government land nor raised any unauthorized construction, and that the work being carried out is only renovation of the existing house. The said written instructions furnished by 2nd respondent are placed on record. 5. Recording the said submissions, the Writ Petition is disposed of. There shall be no order as to costs.
