Learned counsel for the petitioner would vehemently contend that several witnesses have been examined before the concerned Court and none of the witnesses have spoken against the petitioner - accused No.12. He submits that the - 3 - HC-KAR NC: 2026:KHC:130 CRL.P No. 11596 of 2025 petitioner is wanting to draw a finding that there is nothing against the petitioner. 3. The contention of the learned counsel for petitioner that those statements of the witnesses are the statements recorded before the Magistrate under Section 154 of Cr.P.C., which would have to be put into trial and there is nothing against the petitioner and the petitioner would undoubtedly acquitted in the trial. This would not mean that this Court exercising the jurisdiction under Section 482 of Cr.P.C., obliterate the proceedings against the petitioner, by placing its reliance upon the statements recorded from the witnesses under Section 154 of the Cr.P.C. before the learned Magistrate. 4. Learned counsel for the petitioner at this juncture would submit that the trial is not progressing and the petitioner is put to jeopardy as 10 years have passed by. 5. Therefore, the only direction that could be passed is a direction to the concerned Court to expedite the trial and conclude the proceedings expeditiously as possible. - 4 - HC-KAR NC: 2026:KHC:130 CRL.P No. 11596 of 2025 6.
