And In the matter of : Akbar Ali @ Sekh Akbar Ali @ Rajib ……Petitioner. Mr. Sandip Chakraborty Mr. Subhendu Hazra Mr. Samrat Choudhury Mr. Abhijit Bhattacharyya .....for the Petitioner. Mr. Amal Kr. Dutta Mr. Narayan Debnath ……for the State. Learned advocate appearing for the petitioner submits that all other accused persons are on bail, petitioner is better placed than the other accused persons who have been granted bail. Records of the case reflect that this is a cash for job scam. State has produced the Case Diary, relied upon the statement under Section 164 of the Code of Criminal Procedure. I find that so far as the present petitioner is concerned, he was operating through one of the accused person who has already been granted bail. Having considered the same, I am of the opinion that petitioner be released on bail. Accordingly, prayer for bail of the petitioner is allowed. 2 As such, the petitioner namely, Akbar Ali @ Sekh Akbar Ali @ Rajib shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Chief Judicial Magistrate, Purba Bardhaman. If on bail, the petitioner shall be physically present on each and every date before the learned Trial Court and shall not leave the jurisdiction of district of Purba Bardhaman without prior permission of the learned Trial Court. With the aforesaid observations, CRM (M) No. 2624 of 2026 is allowed. The observations made above are only restricted for adjudication of the bail application and should not be considered a final opinion on the merits of the case. Memo of evidence and the copy of order-sheets passed by the learned Sessions Judge be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
