Learned counsel for the petitioner submits that the petitioner is in custody in connection with Maheshpur P.S. Case No. 166/2024 corresponding to ST No. 66/2025 for the offence registered under Sections 376, 313, now said to have been pending in the court of learned Additional Sessions Judge-I, Pakur.

Learned counsel for the petitioner has submitted that as per the complaint petition filed in the year 2024 , the alleged incident had initially taken in the year 2016 and the complaint case has been filed alleging that the victim was raped repeatedly from time to time on the pretext of marriage. She has submitted that in the compliant petition itself, it is mentioned that the victim was 27 years of age in the year 2024. Meaning thereby, she was major at the time of initial date of occurrence also. Further there appears to be a consensual relationship between the parties.

Learned counsel for the opposite party has opposed the prayer and has submitted that there is an allegation that the victim became pregnant and she was aborted. However, the learned counsel has not been able to point out any date or any proof of abortion from the case diary and no such dates have been mentioned in the complaint petition.
4. To this, learned counsel for the petitioner submits that the petitioner is in custody since 27.03.2025.

5. After hearing the learned counsel for the parties and considering the aforesaid submissions, the petitioner is directed to be enlarge on bail on furnishing bail bond of Rs. 25,000/- (Rs. Twenty-Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-I, Pakur in connection with Maheshpur P.S. Case No. 166/2024, subject to the following conditions: - (i) The petitioner will attend the court on each and every date and on account of his single default, the learned court shall cancel the bail bond furnished by the petitioner. (ii) The petitioner would deposit a self-attested copy of his Aadhar Card along with his Mobile Number before the learned court, which he shall not change during the pendency of the case without prior permission of the court. (iii) The petitioner shall fully co-operate with the proceedings before the learned court.
6. The instant bail application is allowed with the aforesaid conditions.
7. Let a copy of this order along with a copy of the affidavit filed with the bail petition be communicated to the court concerned through ‘e- mail/FAX’.
