(AD 26)
(S. Banerjee) CO 3653 of 2026
Madhusudan Kalindi Vs. Rama Kalindi

…for the petitioner
This application under Article 227 of the Constitution of India is at the instance of the husband praying for a direction upon the learned Judge, Family Court, Bankura to dispose of Matrimonial Suit No. 25 of 2022 expeditiously. Learned advocate appearing for the petitioner submits that January 14, 2027 is fixed for framing of issues in the said suit. From the
order-sheets appended to this application this Court finds that a J. Miscellaneous Case has been filed by the opposite-party herein praying for alimony pendente lite. After going through the order dated September 23, 2026 passed in J. Misc. Case No. 102 of 2022 this Court finds that a date has been fixed for filing of affidavit of assets and liabilities and January 14,
2 2027 is fixed for hearing of the said miscellaneous case. In view of the submission made by the learned advocate appearing for the petitioner and considering the fact that a miscellaneous case praying for alimony pendente lite is pending, this Court is of the considered view that the said miscellaneous case for alimony pendente lite is required to be disposed of prior to taking up the hearing of the matrimonial suit. In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite party. However, the learned advocate-on-record of the petitioner shall be obliged to forward a copy of this application along with a server copy of this order, upon the opposite party or upon the learned advocate representing the opposite party before the learned trial judge forthwith. In the light of the submission made by the learned advocate appearing for the petitioner this civil revisional application stands
disposed of by requesting the learned Judge, Family Court, Bankura to take up the hearing of J. Misc. Case No. 102 of 2022 on the next date fixed, i.e., on January 14, 2027 and dispose of the same as expeditiously as possible without granting any unnecessary adjournment to either of the parties.
3 After disposal of the said J. miscellaneous case and subject to the petitioner not in default in complying with any order that may be passed in the said J. miscellaneous case, the learned trial judge shall make an endeavour to dispose of the matrimonial suit expeditiously.
