Islam, learned counsel for the petitioner. Also heard Shri N. Das, learned State Counsel and Ms. G. Hazarika, learned Standing Counsel, Revenue Department. Considering the subject matter involved and as agreed to by the learned counsel for the parties, the instant writ petition is taken up for disposal at the motion stage. Suffice it to mention that this matter was listed earlier on two occasions when instructions were directed to be obtained by the learned State Counsel. Shri Das, the learned counsel has informed that instructions have been obtained. As per the facts projected, the petitioner is a co-pattadar of a plot of land measuring 12.03 lechas covered by Dag No. 3203 of KP Patta No. 2294 situated at Revenue Village Barsajai under Mouza Beltola in the Dispur Revenue Circle. Petitioner claims to be a legal heir of the earlier co-pattadar namely, Lt. Syed Shamsul @ Syed Shamsul Alam, who had passed away on 03.07.2002. The petitioner had applied for mutation by filing an application online which was also acknowledged. However, the said application was not considered for which, the instant writ petition has been filed. Shri Das, the learned State Counsel has submitted that as per the written instructions received the application has been rejected due to want of certain mandatory documents. The written instructions along with the enclosures have Page No.# 3/3 been placed before this Court which have been perused. Under those circumstances, this Court is of the opinion that instead of keeping this writ petition pending, the same is liable to be disposed of by giving liberty to the petitioner to file a fresh application along with all mandatory documents. Writ petition accordingly stands disposed of and the petitioner would be at liberty to file a fresh application for mutation in the manner prescribed along with all mandatory documents. Rejection of the earlier application shall not prejudice the consideration of the fresh representation which has to be done strictly in accordance with law.
