The learned counsel for the petitioner submitted that the petitioner is the absolute owner of the property situated in old S.F. No. 146/2, New S.F. No. 146/2A1B, Mangulam Village, Veppur Taluk, Cuddalore District, by virtue of a Settlement Deed dated 17.04.2025, and is in possession and enjoyment of the same. Previously, respondents 5 to 9 had filed a civil suit in O.S. No. 126/2016 against the petitioner’s predecessor-in-title, seeking a declaration of title; however, the said suit was dismissed as withdrawn. Subsequently, in order to demarcate her boundaries, the petitioner submitted an application to respondents 2 and 3 on 27.04.2026. While the survey proceedings were underway pursuant to the application, the private respondents unlawfully obstructed the process. Consequently, the petitioner has approached this Court seeking a direction to respondents 2 and 3 to survey, measure, and demarcate the lands with necessary police assistance. 3. Ms.Inthu Karunakaran, learned Government’s Counsel, who accepts notice on behalf of the respondents 1 to 3 would submit that the petitioner’s land will be surveyed and demarcated based on his online application dated https://www.mhc.tn.gov.in/judis WP No. 25435 of 2026 __________ Page4 of 6 27.04.2026 along with necessary police aid, within a time frame to be fixed by this Court. 4. Heard the learned counsel for the petitioner as well as the learned Government’s Counsel appearing for the respondents. Since no adverse orders are being passed against the respondents 5 to 9, notice to them is not necessary. 5.Considering the submissions made by both parties and in view of the limited prayer sought for in this writ petition, this Court without expressing any opinion on the merits of the case, directs the respondents 2 and 3 to consider the petitioner’s online application dated 27.04.2026 and also the representation dated 11.05.2026 and conduct a survey and demarcate the subject properties, within a period of six (6) weeks from the date of receipt of a copy of this order, after issuing prior notice and affording an opportunity of personal hearing to the petitioner and other parties concerned including respondents 5 to 9. If any need arises for Police assistance, it is open to the respondents 2 and 3 to request for Police protection from the 4th respondent/jurisdictional Police. If any such request is made, the 4th respondent/jurisdictional Police is directed to provide an adequate Police protection for conducting the survey. 6.In the event of any dispute regarding possession, the official respondents shall not adjudicate upon the question of title. The official respondents shall not involve themselves in such proceedings or take any action affecting the rights of the parties unless specifically directed by the competent Civil Court. 7.With the above direction, this writ petition is disposed of.
