For Petitioner(s): Mr.S.Santhanam For Respondent(s): Mr.S.Yogaraja Sekar Government Advocate (Criminal side) ORDER The petitioner, who was arrested and remanded to judicial custody on 20.12.2025 for the alleged offences under Section 351 (2) of BNS and Sections 5 (l), 5 (j) (ii) r/w 6 (l) of POCSO Act, in Crime No.427 of 2025 on the file of the respondent police, seeks bail. 2.The case of the prosecution is that the petitioner, who is approximately fifty-two years old, committed forcible penetrative sexual assault against the victim, his biological daughter, who is approximately fourteen years old . He further submitted that he is ready to abide by any stringent condition that may be imposed by this Court and ready to co-operate for investigation. Hence, he prays to grant bail to the petitioner. 4.The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and produced the victim’s statement recorded under Section 183 of the BNSS, which contains serious allegations of forcible penetrative sexual assault. He further submitted that the victim became pregnant and subsequently underwent an abortion and that the DNA report is still awaited. Hence, he opposed for grant of bail to the petitioner. 5.A perusal of the statement recorded under Section 183 of the BNSS, clearly demonstrates serious allegations of forcible penetrative sexual assault against the petitioner, who is the victim’s father. Hence, this Court is of the firm view that, it is not desirable to enlarge the petitioner on bail.
