Additionally, it has been submitted that charges have already been framed and the prosecution intends to rely upon 10 witnesses in order to prove its case. Learned advocate for the State oppose the prayer for bail. Having considered that State intends to rely upon 10 witnesses in order to prove its case as also considering the quantum of seizure, I am inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is Allowed. 2 Accordingly, the petitioner viz, Fulchand Sk. @ Chand shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Judge, Special Court under NDPS Act, Suri, Birbhum. If on bail, the petitioner shall be physically present on each and every date of the trial so fixed by the learned trial court and shall not leave the jurisdiction of the district of Birbhum without prior intimation to the learned Special Court.
