The present review petitions have been instituted to review the order of this Court dated 21.04.2017 passed in W.P.Nos.5637 & 5638 of 2017. 2.The review petitioners are third parties and by obtaining leave from this Court, filed the review petitions. 3. Initially, Puducherry State Public Works Department Work Assistants Association along with individuals filed O.A.Nos.725 & 614 of 2014 before the Central Administrative Tribunal, Chennai Bench, to direct the respondents to provide adequate promotional avenues to the post of Work Assistants held by the applicants by including them in the hierarchy of posts available available https://www.mhc.tn.gov.in/judis 2026:MHC:2808 REV.APLW No. 106 of 2026 __________ Page6 of 10 in the Public Works Department on par with Draughtsman and by suitably amending the recruitment rules for the next higher post of Junior Engineer and include the Work Assistants as feeder cadre for promotion and further consider the case of the members of the applicant’s association for such promotion with all consequential benefits. 4. The Central Administrative Tribunal passed final orders on 24.02.2016 by issuing a direction to both the UT Administration and the UPSC which is part of Union of India, to see that the grievances of the applicants are attended positively within a period of six months and the entire process as undertaken by the Pondicherry Administration should be completed. 5. The Union of India filed W.P.Nos.5637 & 5638 of 2017 challenging the order of the Central Administrative Tribunal. The Division Bench of this Court set aside the order of the Central Administrative Tribunal with a finding that the employees in the subject case received the benefits of MACP and thereafter, claimed promotion. This aspect was not considered by the Central Administrative Tribunal. The Tribunal, by issuing positive direction to the Union of India and UT Puducherry and UPSC to amend the recruitment rules and promote the employees to the post of Junior Engineer, virtually acted as the executive as well as the body constituted for giving concurrence to amend the recruitment rules, besides the authority to fill up Group-B posts. With the https://www.mhc.tn.gov.in/judis 2026:MHC:2808 REV.APLW No. 106 of 2026 __________ Page7 of 10 above findings, the writ petitions filed by the Union of India were allowed and the orders passed by the Central Administrative Tribunal were set aside. 6. The respective learned counsels appearing on behalf of the review petitioners Mr.L.Chandrakumar and Mr.Ravichandran would mainly contend that the Central Administrative Tribunal has not issued any positive direction but recorded the arguments made on behalf of the UT Puducherry that the process was in progress during the relevant point of time and thus, the Tribunal directed the authorities to conclude the process positively as expeditiously as possible. Therefore, it would be unnecessary for the High Court to set aside the order of the Central Administrative Tribunal. 7. Mr.Syed Mustafa, learned Special Government Pleader appearing on behalf of the respondents would oppose stating that positive direction issued by the Central Administrative Tribunal would be an impediment to consider the issue independently by the Government. Therefore, the writ petitions came to be filed by the Union of India. The High Court made a finding that the direction issued by the Tribunal to amend the recruitment rules or to create promotional avenue would fall beyond the realm of powers of judicial review and accordingly, set aside the orders passed by the Tribunal. ,Therefore, once again raising the same ground by way of review petitions, is not entertainable. https://www.mhc.tn.gov.in/judis 2026:MHC:2808 REV.APLW No. 106 of 2026 __________ Page8 of 10 8. Though the review petitioners are not parties before the Central Administrative Tribunal and in the writ petitions, Puducherry State Public Works Department Work Assistants filed Original Applications before the Central Administrative Tribunal and the review petitioners before this Court may be acquainted with the association and may have knowledge about the case filed by the association. Even presuming that they are not aware of the fact, the relief sought for, is not entertainable. 9. In view of the said factum, the petitioners have not established any error apparent warranting exercise of review jurisdiction of this Court. Consequently, the Review Petitions are dismissed.
