JUSTICE M.I.ARUN) 1. The review petition is filed against the order dated 15.03.2023 passed in Miscellaneous First Appeal No.6981/2014. 2. Petitioner is the husband and the respondent is the wife. The petitioner had approached the Family Court and filed a petition under Section 13(1) (ia) (ib) and (iii) of the Hindu Marriage Act, 1955 seeking dissolution of the marriage on the grounds of cruelty, desertion as well as unsoundness of mind. On the ground that the petitioner failed to establish the aforementioned allegations against the respondent, the divorce petition filed by the petitioner came to be dismissed by the Family Court. Upon examination of the evidence, this Court confirmed the order passed by the Family Court and dismissed - 3 - HC-KAR NC: 2026:KHC:21358-DB RP No. 480 of 2023 the appeal. It is submitted that, being aggrieved by the order of this Court, the petitioner preferred a Special Leave Petition before the Hon'ble Apex Court, which he withdrew and the same came to be dismissed as withdrawn. 3. On the ground that there have been subsequent events which will entitle the petitioner to get a decree of divorce and if he is allowed to let-in evidence regarding the same, he would be able to prove those facts, the present review petition is filed. 4. It is further submitted that, during the course of hearing of the appeal, an application was made before this Court requesting that the petitioner be permitted to adduce further evidence and the same has not been considered. 5. Admittedly, on the evidence adduced by the petitioner before the trial Court, the Family Court came to the conclusion that the petitioner failed to prove the allegations made against the respondent and accordingly dismissed the petition. Upon re-examination of the evidence on record, this Court has confirmed the order passed by the Family Court. The Special Leave Petition preferred by the petitioner was also dismissed as - 4 - HC-KAR NC: 2026:KHC:21358-DB RP No. 480 of 2023 withdrawn. The petitioner has failed to show any error apparent on the face of the record in the order passed in MFA No.6981/2014. If any fresh cause of action has arisen, the petitioner is always at liberty to file a fresh petition before the Family Court seeking divorce. 6. As the petitioner has failed to show what is the error apparent on the face of the record, the review petition stands dismissed.
