08.10.2026 IN THE HIGH COURT AT CALCUTTA Item No.21 CRIMINAL MISCELLANEOUS JURISDICTION Ct.No.35 dc. Rejected C.R.M. (NDPS) 2076 of 2026 In Re : An Application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Cossipore Police Station Case No. 31 of 2026 dated 22.02.2026 under Sections 20(b)(ii)(c)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985. And In Re : Parikshit Barman ... Petitioner. Mr. Apan Saha, Mr. Hillol Saha Podder, Mr. Tasnim Ahamed ... For the Petitioner. Mr. Rajendra Banerjee, APP, Mr. Lokesh Sharma, Mr. Shataroop Purkayastha ... For the State. Learned advocate appearing for the petitioner submits that petitioner has been implicated on the basis of statement of co-accused in a case where there has been alleged recovery of 33.745 kgs. of Ganja from other persons. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that there are money trail and CDRs with the accused persons from whom recovery has been made. Having considered the aforesaid, I am of the opinion that Section 29 of the NDPS Act is attracted. As such, the rigours of Section 37 of the NDPS Act are applicable to the present case. Accordingly, the prayer for bail of the petitioner is rejected. 2 Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (NDPS) 2076 of 2026, is, thus, dismissed. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
