He was dismissed from service vide order dated 27.08.2019; however, in appeal, the punishment given to him was modified and penalty of reduction to minimum pay scale was imposed upon him. 3. In this writ petition, petitioner has challenged the order passed by Revisional Authority. 4. Learned State Counsel submits that since petitioner is amenable to jurisdiction of PST and he was a public servant, therefore he should have approached the Public Service Tribunal (PST) instead of directly approaching this Court. He further submits that writ petition is liable to be dismissed on the ground of statutory remedy available to him. 5. Learned counsel for the petitioner do not dispute the submission made by learned State Counsel. 6. Since writ petition was filed in 2022 and 2026:UHC:1610 pleadings have also been exchanged, therefore, the case is hereby transferred to Uttarakhand Public Service Tribunal where it shall be registered as claim petition and be heard and decided expeditiously. 7. Counsel for the petitioner undertakes to supply photocopy of entire record of the writ petition in the registry which shall be maintained in the records of the Registry.
