ORDER The present petition has been filed by the sole accused in STC No. 105 of 2022 on the file of Judicial Magistrate, Ilayangudi seeking to quash the charge sheet, wherein, the petitioner is charged with the offence under Sections 294(b), 447, 353, 506(1) IPC. 2.Perusal of the charge sheet reveals that the petitioner is said to have trespassed into the office of Tahsildar, abused and attacked them. 3.The grievance of the petitioner is that the counter FIR registered by the petitioner in Cr.No.137 of 2022 has been closed as 'mistake of fact' and therefore, he submits that the present complaint is a false complaint. 4.The learned counsel appearing for the petitioner submits that even though the list witnesses in the present case are Government Officials, they are not appearing for the past four years and the police officials have not initiated any action to marshal the witnesses. 5.Heard the learned counsel appearing for the petitioner and perused the material records. 2/5 https://www.mhc.tn.gov.in/judis
Crl.OP(MD) No.13925 of 2026 6.As could be seen from the records that there are specific overt act against the petitioner and this Court is not inclined to entertain the present quash petition. As could be seen from the e-Court records, for the past four years witnesses have not been produced, despite the fact that they are Government officials. 7.In such view of the matter, there shall be a direction to the first respondent to marshal the witnesses before the trial Court at regular intervals. The learned Judicial Magistrate, Ilayangudi is directed to dispose of the case in STC No.105 of 2022 on or before 31.12.2026. 8.With the aforesaid observations, this Criminal Original Petition stands disposed of.
