14.10.2026 Serial no. 138 [G.S.Das] Assistant Registrar (Court) CRM (NDPS) 2244 of 2026 In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with Kaliachawk PS Case No. 397 of 2022 dated 16.04.2022 u/s 21(c)/29 of the NDPS Act [Special case no. 57 of 2022]. -And- In the matter of : Sariful Islam @ Kalu Sk. … … Petitioner(s) Mr. Sandip Chakraborty Mr. Kaustav Das Ms. Payel Das … for the Petitioner(s) Mr. Soumak Bera Mr. Shoumilya Mazumder … for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner is in custody for three months ten days and there has been no recovery from the present petitioner. Learned advocate added that the petitioner has been arrested only on the basis of statement of a co-accused. State opposes the prayer for bail on the ground that there are eight antecedents of the present petitioner. The records reflect that in seven of the cases, the petitioner has been implicated only on the basis of statement of a co-accused and in one case there was recovery from the present petitioner. Having considered that there has been no recovery from the present petitioner in this case and the petitioner in 2 this case has been implicated only on the basis of statement of a co-accused, I am inclined to release the petitioner on bail. Hence, the prayer for bail of the petitioner is Allowed. Accordingly, the petitioner viz, Sariful Islam @ Kalu Sk.y shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned CJM, Malda. If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned Special court/trial court and shall not leave the district of Malda without prior permission of the learned Special court/trial court or the court in seisin of the case. Accordingly, CRM (NDPS) 2244 of 2026 is allowed. Pending application(s), if any, is also disposed of. The observations made above are only restricted for adjudication of the bail application and should not be considered as final opinion on the merits of the case.
