Earlier direction of this Court in CRM (M) 1690 of 2025 reflects that the prosecution was directed to examine at least 10 more witnesses within a period of 6 months. It has been informed that the evidence of the 2nd witness is in progress. The time period of another 2 months is still left. State would at least show that goodself prevail on them. Of late, I find that in some of the trial courts and obviously the prosecution, a habit has developed for ignoring 2 the orders of the High Court. I repeat that in each district the Superintendent of Police concerned are directed to abide by the orders of the High Court and not to invite any unnecessary unwarranted orders from this Court. The other issue which has been canvassed by the petitioner is relating to his health. So far as the health issue is concerned, the concerned Superintendent/Deputy Superintendent of the Jail will seek advice of the medial officers of the jail. There are documents which have been enclosed regarding treatment of the petitioner. It would be the discretion of the concerned medical officer to advise the Deputy Superintendent or the Superintendent of Jail in respect of the health issues concerned. With the aforesaid observations CRM(M) 305 of 2026 is disposed of. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
