For Bail in Crime No. 207/2026 on the file of the respondent police. ORDER : The Court made the following order :- The petitioners / A1, A3 and A4, who were arrested and remanded to judicial custody on 07.06.2026, for the offences punishable under Sections 75, 79, 115(2) and 351(3) of BNS, 2023, and Section 4 of TNPHW Act, 2002 in Crime No.207 of 2026 on the file of the respondent police, seek bail. 2. The allegation against the petitioners is that the petitioners joined together and while the victim was talking with her husband in front of the house, the petitioners went there and attempted to molest her in the front of her husband and they have also attacked her. The learned counsel appearing for the petitioners submitted that the petitioners are innocent and they have been falsely implicated in this and they have not committed any offence as alleged by the prosecution. They are ready to cooperate with the investigation. Hence, he prayed to grant bail to the petitioners. 4.The learned counsel for the State of TN (Crl. Side) reitereated the prosecution and submitted that the first petitioner is having 5 previous cases, the second petitioner is having five previous cases and the third petitioner is having seven previous cases. The investigation in this case is pending. Hence, he opposed to grant bail to the petitioner. 5. This Court heard both sides and perused the materials available on records. 6. Considering the facts and circumstances of the case and considering the period of incarceration and though the petitioners have previous cases, I am inclined to grant bail to the petitioners subject to certain conditions. 3/7 https://www.mhc.tn.gov.in/judis CRL OP(MD). No.14227 of 2026 [a] Accordingly, the petitioners are ordered to be released on bail on condition to execute a bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.1, Madurai, and on further conditions that: [b] the petitioners shall report before the learned Judicial Magistrate No.1, Madurai, on all working days at 10.30 a.m., for a period of four weeks, thereafter as and when required for interrogation before the respondent Police; [c] the petitioners shall not commit any offence similar to the offence of which he/she is accused, or suspected, or of the commission of which he/she is suspected; [d] the petitioners shall not abscond either during investigation or trial; [e] the petitioners shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade her from disclosing 4/7 https://www.mhc.tn.gov.in/judis CRL OP(MD). No.14227 of 2026 such facts to the Court or to any police officer or tamper with the evidence; [f] On breach of any of the aforesaid conditions, the learned Judicial Magistrate/Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 51730].
