HC-KAR NC: 2026:KHC:5773 RPFC No. 182 of 2024 ORAL ORDER Heard Sri.Shrishail A Hubli learned counsel for the petitioner who appears before this Court physically. Also heard Ms.Prameela Nesargi learned Senior counsel who represents the respondents and appears through video conference.
2. Challenge in this revision petition is the order that is rendered by the Court of IV Additional Principal Judge, Family Court, Bengaluru in Crl.Misc.No.272/2017 dated 14.06.2024.
3. The relationship between the parties is not in dispute. Thus, the petitioner herein is the husband of respondent No.1 and father of respondent No.2.
4. Respondents filed a petition under Section 125 Cr.P.C. claiming maintenance of Rs.1,25,000/- per month. The Family Court, through the impugned order held that respondent No.2 herein is entitled for a sum of Rs.25,000/- per month from the date of petition till

HC-KAR NC: 2026:KHC:5773 RPFC No. 182 of 2024 11.04.2022 and Rs.35,000/- per month from 12.04.2022 till he attains the age of majority with educational expenses till he completes his bachelor degree. The Court has not granted any sum as maintenance to respondent No.1.
5. The entire submission of learned counsel for the petitioner is based on the order that is rendered by the Court of III Additional Principal Judge, Family Court at Bengaluru on I.A.No.III in M.C.No.3021/2012 dated
11.04.2022. Through the order in said interlocutory application, the Court directed the petitioner herein to pay interim maintenance of Rs.5,000/- per month to the child i.e. respondent No.2 herein from the date of filing of the said interlocutory application till June 2016 and thereafter Rs.10,000/- per month till the date of order apart from educational expenses.

6.
Learned counsel for the petitioner submits that the Family Court without taking into consideration the orders rendered on I.A.No.III again granted huge sum as maintenance, which is improper.
7. Per contra, learned Senior Counsel for the respondents submits that the Family Court taking into
consideration the interim arrangement made through orders on I.A.No.III in M.C.No.3021/2012 dated 11.04.2022 passed a reasoned order and therefore, the said order needs no interference.
8. The Family Court subjecting the evidence of PW1, Rw1, Exs.P1 to P6 and Ex.R1 came to a conclusion that respondent No.2 is entitled to maintenance as indicated in the said order. A perusal of the impugned
order reveals that the learned Judge of the Family Court has taken into consideration each and every aspect of the case including the orders rendered on I.A.No.III in

HC-KAR NC: 2026:KHC:5773 RPFC No. 182 of 2024 M.C.No.3021/2012. Para 16 of the impugned order reflects
discussion on the said aspect.
9. So far as earnings and assets of petitioner are concerned, the Court at para 15 of the order, apart from discussing the earnings of respondent No.1 herein, also made a mention that the petition was filed in the year 2017 and by then the petitioner herein, who is the respondent in the said case, was working in a company called Symphony Teleca Corporation as Sr.Software Engineer and thereby was earning Rs.10,00,000/- per annum and the house where he resides was purchased by him in the year 2016 and presently working as manager earns more than Rs.43,00,000/- per annum including perks. The Court also made a mention that petitioner herein earns around Rs.3,58,333/-. Having considered the financial capacity of petitioner and the earnings of respondent No.1 and further taking into consideration the interim arrangement made through orders on I.A.No.III in M.C.No.3021/2012, directed petitioner herein to pay a

HC-KAR NC: 2026:KHC:5773 RPFC No. 182 of 2024 sum of Rs.25,000/- per month from the date of petition till 11.04.2022 and Rs.35,000/- per month from 12.04.2022 till the child attains the age of majority. By the submission that is made by both the learned counsel, it is clear that I.A.No.III in M.C.No.3021 of 2022 was disposed of on
11.04.2022. Thus, it is clear that from 12.04.2022, petitioner was directed to pay Rs.35,000/- per month and for the preceding period, taking into consideration the fact that petitioner was already under obligation to pay Rs.10,000/- as per the interim arrangement made through orders on I.A.No.III in M.C.No.3021/2022, he was directed to pay Rs.25,000/- only through the impugned order. Thus, it is clear that the Family Court did not err either in deciding the quantum of amount which respondent No.2 is entitled to receive as maintenance or the period of payment. Thus viewed from any angle, this revision petition lacks merits.
