This is an application for relaxation of bail condition no.(vi) imposed by this Court while granting bail vide order dated 17.09.2025, which reads as under : “vi) The applicants shall not enter the Yavatmal district during the period of trial except to attend the Court.” 3. Learned Counsel for the applicants submits that in another application filed by the co-accused, said condition was relaxed for him. In the present case the applicant no.1 is suffering from various ailments and need day to day care. So also, he applicant is senior citizen and frequent treatments are required under the guidance of expert doctor. He also need to take opinion of orthopedic surgeon located at Yavatmal in order to treat femur fracture and therefore, is seeking relaxation of aforesaid condition. 4. On the other hand, learned APP vehemently 2 17.appp.2869.2026 opposed the application on the ground that the applicants have readily accepted the said condition at time of granting bail. Said condition was imposed with certain objective and further the Trial is going on, on day to day basis. Hence, the application is prayed to be rejected. 5. I have considered the rival submissions and perused the record. It appears that the trial is going on, on day to day basis and the applicant are attending the trial at Yavatmal, under such circumstances, when the applicant is entering into the Yavatmal, at that time, he can very well take the treatment as per his requirement.
