1. The second bail application has been filed under Section 483 of BNSS, 2023 on behalf of accused-petitioner in connection with FIR No. 391/2025 registered at Police Station Udyog Nagar (MIA), District Alwar for offences punishable under Section 303(2) of B.N.S., 2023.
2. Heard.
3. Considered the submissions made by counsel for the accused-petitioner as well as learned Public Prosecutor and also perused the challan papers.
4. The allegation against the accused-petitioner is of involvement in the theft of motorcycle. It is submitted by the
learned counsel for the petitioner that the accused-petitioner has bee falsely implicated in this case merely because of some other criminal cases of theft of a period prior to 2018 are pending against the accused-petitioner. It is also submitted by the counsel
[2026:RJ-JP:8682] (2 of 2) [CRLMB-3189/2026] that the accused-petitioner is in custody since 23.12.2025 and police after completion of the investigation has submitted charge- sheet in the matter.
5. Learned Public Prosecutor opposed the bail application and submits that there are other criminal cases pending against the accused-petitioner.
6. As regards the pendency of other criminal cases, they were relate back prior to the year 2018.
7. Taking into consideration the allegation against the accused-petitioner as also that he is in custody since 23.12.2025 as well as the fact that police after completion of the investigation has submitted charge-sheet, this Court, without expressing any opinion on merits or demerits of this case, deems just and proper to enlarge the petitioner on bail.

Accordingly, the second bail application is allowed and it is directed that accused-petitioner shall be released on bail provided that he furnishes a personal bond in the sum of Rs. 1,00,000/- (Rupees One Lac Only)(each), together with two sureties in the sum of Rs. 50,000/- (Rupees Fifty Thousand Only) each to the satisfaction of the Trial Court with the stipulation that he shall appear before that Court or any Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
