This petition under Article 226 of the Constitution of India has been preferred by petitioner seeking following reliefs:- “10.1 That, this Hon’ble Court may kindly be pleased to issue a suitable writ or writ for directing RUKHSAR BANO Digitally signed by RUKHSAR BANO Date: 2026.01.29 10:25:32 +0530 2 the respondent no.1 to 4 to make a proper enquiry/ investigation against the respondent no.5 regarding alleged financial irregularities of Rs.8,77,995/- which was made to firm by the respondent no.5 from 15th Finance in the DSC of old Sarpanch of Village Pand and if found guilty of respondent no.5 then he should be punished in accordance with law. 10.2 Any other relief deemed fit in the facts and circumstances of the case may also be granted.” 3. Learned counsel appearing for the petitioner would submit that the petitioner is an elected Sarpanch of Village Panchayat Pand, Janpad Panchayat Takhatpur, District Bilaspur (CG) since 25.02.2025. He would further submit that earlier private respondent No.5 was posted as Secretary of Village Panchayat Pand till 05.05.2025 and was subsequently transferred to Village Panchayat Monch and thereafter, to Village Panchayat Kapasiyakala. He was also given additional charge as Secretary of Village Panchayat Pand. Learned counsel further submitted that earlier private respondent No.5 had committed financial irregularities in respect of the funds of 15th Finance Grant. In this regard, a complaint was made by Sarpanch, Up-sarpanch and other members of Village Panchayat Pand against the respondent No.5 to the respondents No.2 and 3. Pursuant thereto, respondent No.2, vide communication dated 28.07.2025, directed respondent No.4 to submit a report within seven days after conducting due enquiry, despite that, respondent No.4 has not complied with the said communication (Annexure-P/7). Hence, learned counsel prays that this petition may be disposed of with a direction to respondent No.4 to comply with the communication/order (Annexure-P/7) made by respondent No.2. 3 4. Learned State counsel has no objection to the prayer made by learned counsel for the petitioner. 5. Perusal of communication/ order (Annexure-P/7) shows that the said communication/order was made by respondent No.2 to the Chief Executive Officer Janpad Panchayat/respondent No.4, directing him to conduct enquiry against respondent No.5 pertaining to the alleged financial irregularities committed by him in respect of the funds of 15th Finance Grant. Despite the specific order given by superior authority, respondent No.4 has not complied with the order, as stated by counsel for the petitioner. 6. Upon due consideration, this petition is disposed of directing respondent No.4 to comply with the communication/order dated 28.07.2025 (Annexure-P/7) made by respondent No.2, within a period of 30 days from the date of receipt/submission of a copy of this order and to submit the enquiry report immediately to respondent No.2. 7. It is further directed that respondent No.3 shall ensure compliance with communication dated (Annexure-P/7) within aforesaid period. 8. With aforesaid observation and direction, this writ petition stands disposed of. 9. Pending interlocutory application(s), if any, also stands disposed of. No order as to cost(s).
