15.10.2026 Court No.35. D/L.01. Rakib CRM (M) 1771 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kaliachak Police Station case no. 485 of 2023 dated 25.04.2023 under Sections 201/302 of the Indian Penal Code and Section 6 of the POCSO Act, 2012. And In the matter of : Biswajit Mandal ……Petitioner. Mr. Kallol Mondal, Ld. PP Mr. Aditya Tiwari Ms. Namrata Chatterjee ……for the State. Show-cause submitted by the Inspector-in-Charge, Kaliachak Police Station is accepted. As a matter of last chance, this police station is granted caution to change their attitude towards the Hon’ble High Court or for that matter all the Courts concerned. The functioning of the police station is a cause of worry for the judiciary. There are number of issues relating to the said police station. Earlier umpteen number of cautions were issued and necessary information was sent to the Superintendent of Police, Malda. It does not reflect that there has been any change on behalf of the officials working in the said police station. In this case the report was not only incorrect but was in a manner interfering with the administration of criminal justice. 2 Since the police authorities are apologetic, a last chance is granted to the whole police station. Good sense should prevail henceforth upon the police station and its officials. Earlier direction so far as the Inspector-in-Charge for imposing of fine is concerned, the same is hereby waived. The Superintendent of Police, Malda will henceforth monitor this particular police station and the nearby police stations being English Bazar, Gazole and Chanchal police station with firm hand. There should not be any administrative lapse so far as fault of these officers are concerned, rest when it comes to the notice of the judiciary it will be dealt with in a firm manner. With the aforesaid observations, the application being CRM (M) 1771 of 2023 is disposed of. Learned Registrar General High Court Calcutta is directed to communicate this order to the Director General of Police as well as the Superintendent of Police, Malda. Show-cause report submitted by the Inspector-in-Charge, Kaliachak Police Station be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
