Mr. Angshuman Chakraborty Mr. S. S. Saha …for the Petitioner
Mr. Gouranga Kumar Das, APP Ms. Moumita Pandit … for the State
Mr. Narendra Nath Malakar … for the De facto Complainant
1. Report submitted by the learned counsel for the State is kept with the record. 2. Learned counsel for the petitioner submits that the petitioner is in custody for 6 months and charge-sheet has been submitted. There is no reason for keeping the petitioner in custody and the petitioner may be released on bail. 3. Learned counsel for the de facto complainant submits that it is not correct that the petitioner is in custody for 6 months. The petitioner is in custody for 3 months 9 days. Moreover, the petitioner did not enclose the copy of the order of rejection by the learned Additional District Judge, Haldia with the present bail
2 application. The learned counsel for the de facto complainant has relied upon the judgment of the Hon’ble Supreme Court passed in the case of Prasanta Kumar Sarkar Vs. Ashis Chatterjee and Another reported in (2010) 12 SCR 1165. 4. Learned counsel for the State opposes the prayer for bail. 5. It appears from the record that the charge-sheet has been submitted and investigation is complete. I do not find any need for keeping the petitioner in custody. 6. Accordingly, the application for bail of the petitioner, namely, Aditya alias Aditya Prasad Mal alias Aditya Mal is allowed. 7. I direct the petitioners will be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand only), with two sureties of like amount each, one of whom must be a local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Haldia.
The petitioner shall appear before the learned Trial Court on each and every day of substantive hearing subject to the provisions of Section 317 of the Code of Criminal Procedure, 1973/Section 355 of the Bharatiya Nagarik Suraksha Sanhita, 2023 and shall not intimidate the witnesses and/or tamper with evidence in any manner whatsoever. The petitioner shall not enter the jurisdiction of Sutahata Police Station except for the purpose of attending Court and shall remain within the geographical limits of the district of Purba Medinipur and shall furnish his local address where he shall reside to the learned Trial Court and shall meet the Inspector-in-Charge of the local jurisdictional Police Station once in a week until further orders. 3
8. In the event, the petitioner fails to comply with any of the conditions as stated above, the learned Trial Court shall be at liberty to cancel his bail in accordance with law without further reference to this Court. 9. Thus, the application for bail being C.R.M. (M) 2558 of 2026 stands disposed of. 10. All parties shall act on the server copy of this order duly downloaded from the official website of this Hon’ble Court. 11. Urgent Photostat certified copy of this order, if applied for, be given to the parties upon compliance with all requisite formalities. (Apurba Sinha Ray, J.)
