2. Petitioner is serving as Assistant Technical Officer in Uttarakhand State Warehousing Corporation. He has challenged the seniority list published on 06.09.2023, and also the order of promotion passed in favour of respondent No. 3 on
02.09.2024.

Learned counsel for Uttarakhand State Warehousing Corporation submits that petitioner has remedy of approaching Public Services Tribunal, established under Uttarakhand Public Services Tribunal Act, 1976. He submits that petitioner is a public servant within the meaning of the term as defined under Section 2(b)(iii) of the aforesaid Act, as Uttarakhand State Warehousing Corporation is owned and controlled by Government of Uttarakhand.

Learned counsel for petitioner do not dispute the said submission. He submits that since pleadings have been exchanged between the parties, therefore, record of the case be relegated to learned Tribunal.

5. Accordingly, the writ petition is transferred to Uttarakhand Public Services Tribunal along with original records.
6. Registry shall replace the original record with photocopies thereof, to be supplied by learned counsel for the petitioner.
