1 D/L 13 15.10.2026 Rohit, A.R.(Ct.) ct.no.33 IN THE HIGH COURT AT CALCUTTA CRIMINAL MISCELLANEOUS JURISDICTION APPELLATE SIDE C.R.M (M) 2228 of 2026 Saiyed Mahidul Islam @ Lalan Vs The Central Bureau of Investigation In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 arising out of Ramnagar Police Station Case No. 89 of 2021 dated 06.06.2021 under Sections 302/34 of the IPC. And In the matter of : Saiyed Mahidul Islam @ Lalan …Petitioner. Ms. Rajnandini Das Mr. Karan Bapuli …for the Petitioner Mr. Amajit De, Spl. PP …for the CBI 1. The Learned Advocate representing the petitioner argues a renewal for prayer for bail since the petitioner’s application for bail was previously dismissed by the Co- Ordinate Bench of this Court vide Order dated 18.02.2025 in CRM(DB) 4123 of 2024 and a further prayer seeking for bail had been rejected by the Jurisdictional Court on 13.12.2025 in Sessions Trial No.7(5) of 2023, the petitioner to have been falsely implicated in the offences without any clinching evidence of direct involvement in the same. The petitioner had been in custody since 04.04.2023. As certain other co-accused persons had also been enlarged on bail and the conclusion of trial in near future being impossibility, the petitioner also prayed for grant of bail. 2 2. CBI cited 49 witnesses in the charge-sheet to be examined. 3. The Learned Advocate representing the CBI submitted the accused to have actively involved in the alleged offence whereby he died on the spot and medical report from the AIIMS hospital opined the severity of head injury resulting out of the continuous assault on the deceased victim with the involvement of the petitioner and the co-accused persons. Moreover, the vulnerable witnesses had not yet been examined. Possibility of intimidating the witnesses and tampering the evidence, if the petitioner is released on bail, will frustrate the prosecution case therefore the prayer for grant of bail shall be denied. 4. The Learned Advocate representing the CBI submitted to reduce the number of witnesses to be examined to 50 out of which 12 witnesses have been examined till date. The petitioner to have been in custody for more than two and a half years and 12 out of 50 intended witnesses to have been examined entail the petitioner to be enlarged on bail since the completion of recording evidence will not be conducted in near future. 5. The prayer for bail in the instant case is considered and allowed. 6. Accordingly, petitioner, namely, Saiyed Mahidul Islam @ Lalan shall furnish bond of Rs. 50,000/- (Rupees Fifty Thousand Only) with two sureties of Rs. 25,000/- (Rupees 3 Twenty Five Thousand Only) each, one of whom must be local to the satisfaction of Learned Additional Chief Judicial Magistrate, Diamond Harbour, South 24 Parganas. 7. The petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of the Trial Court without prior permission from the same and the petitioners shall not intimidate witnesses or tamper with evidence in any manner whatsoever and on further condition the petitioners shall meet with the Officer-in-Charge of the local Police Station thrice a week until further orders. 8. In the event the petitioner fails to appear before the trial Court without justifiable cause, the Trial Court shall be at liberty to cancel their bail automatically without reference to this Court. 9. Accordingly, CRM (M) 2228 of 2026 is allowed. 10. Memo of evidence submitted be kept with the record. 11. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. 12. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Ananya Bandyopadhyay, J.)
