The present application under Section 528 of Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed by the applicants to quash the entire proceedings of Criminal Case No. 76152 of 2025, arising out of case crime No. 194 of 2022, under Sections 323, 504, 506, 354-Kha, 325 of I.P.C., Police Station- Shivpur, District Varanasi as well as cognizance/summoning order dated 4.12.2025, pending in the court of Civil Judge (Junior Division)/F.T.C, Varanasi. After some arguments, learned counsel for the applicants does not want to press this application and wants liberty to file appropriate application/proceedings before the court of competent jurisdiction. The instant application is dismissed as not pressed with liberty to file appropriate application/proceedings before the court of competent jurisdiction.
