ORDER : The Court made the following order :- The petitioner /Accused, who was arrested and remanded to judicial custody on 12.06.2026, for the offences punishable under Sections 316(5), 336(2) and 341(2) of BNS, 2023, in Crime No.293 of 2026 on the file of the respondent police, seeks bail. 2. The allegation against the petitioner is that the petitioner joining hands with the other accused involved in issuance of fabricated documents including fake death certificates after collecting money from the concerned persons. Based on the said allegations, the present case was registered. During the course of investigation, it was revealed that the petitioner in collusion with other temporary staff members had committed the alleged offences and was also involved in the misappropriation of a sum of Rs.61,900/-. Accordingly, the petitioner was arrested. 3.The learned counsel appearing for the petitioner submitted that Some of the other incriminating materials have been recovered only from the other accused and not from the present petitioner. He further submitted that the petitioner is ready to deposit the misappropriated amount of Rs.61,900/-, without prejudice to his rights and defence in the trial court. Hence, he prayed to grant bail to the petitioner. 4.The learned Counsel for the State of TN (Crl. Side) appearing for the respondent Police reitereated the prosecution and submitted that the petitioner is a permanent staff and he joined hands with the other accused committed the said offences. The investigation in this case is still pending. Hence, he opposed to grant bail to the petitioner. 5.This Court heard both sides and perused the materials available on records. 6.Considering the facts and circumstances of the case and nature of the allegation and also the fact that the petitioner has also been suspended from service and he is ready to deposit the alleged misappropriated amount of Rs.61,900/- and also considering the period of incarceration undergone by the petitioner, this Court is inclined to grant bail to the petitioner, subject to certain conditions. CRL OP(MD). No.14198 of 2026 Rs.61,900/-(Rupees Sixty one Thousand and nine Hundred only) to the credit of Crime No.293 of 2026 within a period of 15 days before the learned Judicial Magistrate No.IV, Tirunelveli.
The learned Judicial Magistrate or Trial Court shall pass orders regarding entitlement of the said amount in its final order/Judgment. [b]On such deposit being made, this petition is ordered and the petitioner is ordered to be released on bail on condition to execute a bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.IV, Tirunelveli and on further conditions that: [c] the petitioner shall report before the respondent Police daily at 10.30 a.m., for a period of four weeks and thereafter, as and when required for interrogation. facts to the Court or to any police officer or tamper with the evidence; [g] On breach of any of the aforesaid conditions, the learned Judicial Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].
