This Writ Petition has been filed for issuance of Writ of Mandamus, directing the 2nd respondent to revoke the suspension order issued by the 2nd respondent vide proceeding No.A4/2517/2025, dated 03.04.2025 and reinstate the petitioner into service based on the representation dated 19.06.2026 submitted by the petitioner in the light of G.O.Ms.No.81 Human Resources Management (N) Department, dated 04.08.2022. 3. With the consent of both parties, this Writ Petition is disposed of at the admission stage. 4. The petitioner, while working as a Village Administrative Officer at Thalakkulam Village, Kalkulam Taluk, was involved in a Vigilance and Anti-Corruption case in Crime No.1 of 2025, dated 2/6 https://www.mhc.tn.gov.in/judis W.P.(MD)No.19072 of 2026 01.04.2025, and was arrested and remanded to judicial custody. In view of the same, the petitioner was placed under suspension vide proceedings dated 03.04.2025. The petitioner also submitted a representation dated 19.06.2026 to the respondents. However, no response has been received thereto. The petitioner is stated to have been continued under suspension till date, as the said suspension has neither been reviewed nor revoked. Hence, the petitioner has approached this Court by filing the present Writ Petition contending that the respondents have failed to review the order of suspension in terms of G.O.Ms.No.81, Human Resources Management (N) Department, dated 04.08.2022. 5. Mrs.K.Porkodi, learned Government Pleader appearing for the respondents, submits that the 2nd respondent, who placed the petitioner under suspension, is under an obligation to take into consideration paragraph 11(iv) of G.O.Ms.No.81, Human Resources Management (N) Department, dated 04.08.2022, and pass appropriate orders accordingly. 6. For better appreciation, it would be relevant to extract paragraph 11(iv) of G.O.Ms.No.81, Human Resources Management (N) Department, dated 04.08.2022, which reads as follows: “11...... (iv). In respect of cases referred to items (ii) and (iii) above, the authority who ordered the suspension or the Director of Vigilance and Anti-Corruption, as the case may be should before the expiry of the period of three months, report the matter to the Head of the Department/Government, indicating the progress of the disciplinary action/investigation by the Director of Vigilance and Anti-Corruption, the reasons for non completion of the work and the further time required for completing the disciplinary action/investigation and furnish reasons for continuing the suspension, if continued suspension is felt essential. If the authority which initiated action in the first instance is the Head of the Department, the report has to be sent to Government” 4/6 https://www.mhc.tn.gov.in/judis W.P.(MD)No.19072 of 2026 8. In the light of the aforementioned Government Order, this Writ Petition is disposed of by directing the 2nd respondent to review the order of suspension dated 03.04.2025, taking into consideration paragraph 11(iv) of the said Government Order, and pass appropriate orders as expeditiously as possible, at any rate, within a period of six weeks from the date of receipt of a copy of this order.
