Quash the impugned FIR dated 11.07.2024 bearing Crime No. 317 of 2024 registered at Police Station Basantpur, District Rajnandgaon (C.G.) for the offence under Section 74 of Bhartiya Nyay Sanhita, 2023 against the petitioner. ii. Quash the impugned final report bearing Final Report No. 259 of 2024 dated 23.08.2024 filed by Police Station, Basantpur before the learned Judicial Magistrate First Class, Rajnandgaon (C.G.) for the offence under Section 74, 296 of BNS (Annexure P/1) against the petitioner. iii. Quash the impugned undated cognizance order as well as charge dated 10.10.2024 and entire criminal proceedings pending against the petitioner in Criminal Case No. 4795 of 2024 pending against the petitioner before the learned Judicial Magistrate First Class, Rajnandgaon (C.G.). iv. Grant any other relief(s) which this Hon’ble Court may deem fit in favour of petitioner may also be granted.” 3. On perusal of the order-sheet dated 15.11.2025 of the learned trial Court, it is evident that the case is fixed for prosecution evidence on 3 28.01.2026, and the learned trial Court has issued bailable warrants against PW-1, PW-2, and PW-3. However, in the opinion of this Court, the present petition has been filed in a casual manner, as the petitioner has not placed on record the complete order-sheet of the learned trial Court subsequent to 15.11.2025. 4. Learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to file a fresh petition, along with the complete order-sheet of the learned trial Court. 5. Learned State counsel has no objection to the said prayer. 6. In view of the submissions made by learned counsel for the petitioner, the present petition is dismissed as withdrawn, with liberty as prayed for, subject to the petitioner depositing a sum of Rs. 1,000/- as costs before the Registry of this Court and producing the receipt thereof at the time of filing any fresh petition. The amount so deposited shall be transmitted to the Government Specialized Adoption Agency, Gariyaband, District Gariyaband (C.G.). 7. Certified copies of the FIR, charge-sheet, and other documents, if any, shall be returned to the petitioner after retaining photocopies thereof on record.
