HC-KAR NC: 2026:KHC:6983 WP No. 21301 of 2023
THIS WP IS FILED UNDER ARTICLE 227 OF THE CONSTITUTION OF INDIA PRAYING TO QUASH THE ORDER DTD 07.08.2023 PASSED ON IA NO. V IN MC NO. 3337/2020 ON THE FILE OF IV ADDL PRL JUDGE FAMILY COURT BENGALURU VIDE ANNX-A AND ETC.,
THIS PETITION, COMING ON FOR PRELIMINARY HEARING IN 'B' GROUP, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE DR. JUSTICE CHILLAKUR SUMALATHA ORAL ORDER Heard Ms. Jayalakshmamma, learned counsel for the petitioner. 2. Being aggrieved by the order passed by the Court of IV Additional Principal Judge, Family Court, Bangalore on I.A.No.V in M.C.No.3337/2020 dated 07.08.2023, this petition is filed. 3. The respondent herein, who is the wife of the petitioner, filed an interlocutory application in M.C. No.3337/2020 seeking the Court to direct the petitioner/husband to pay her Rs.10,000/- per month towards maintenance and Rs.40,000/- towards the education and other expenses of her minor daughter. - 3 -
HC-KAR NC: 2026:KHC:6983 WP No. 21301 of 2023 Family Court through the impugned order, directed the petitioner herein to pay the respondent/wife a sum of Rs.10,000/- per month as interim maintenance. 4. Making her submission with regard to the merits of the matter, learned counsel for the petitioner contends that the petitioner is an auto driver. He earns not more than Rs.12,000/- per month. On the other hand, respondent/wife as a Teacher was earning Rs.20,000/- per month and as Tailor Rs.30,000/- per month as on the date of filing of I.A.No.V. Subsequently, she got selected as a Home Guard in Police Department and at present she has got permanent source of income. But without considering the financial status of both the parties, the Family Court directed the petitioner herein to pay huge sum of Rs.10,000/- per month to the respondent which is unfair. Learned counsel thereby seeks to set-aside the impugned order. 5. Though notice was served upon the respondent, respondent did not choose to contest the matter. - 4 -
HC-KAR NC: 2026:KHC:6983 WP No. 21301 of 2023
6. In the petition filed by respondent herein seeking interim maintenance, she clearly narrated that her husband is an auto driver and he receives rent from his parents' property. She also stated that she is doing tailoring work part-time and as part- time teacher, she is earning meager amount. She further stated that her daughter is studying SSLC and she has to incur educational expenses. 7. Though before this Court, learned counsel for the petitioner contended that respondent got selected as Home Guard in Police Department, no proof is to that effect is on record.
However taking into consideration the occupation of the petitioner that he is an auto driver which fact is affirmed by respondent also, as no material is brought on record to show that petitioner has got other source of earnings, that respondent/wife herself disclosed that she is doing tailoring work and also attending school as a part-time Teacher, this Court considers desirable to reduce the sum that is awarded as interim maintenance
