Pinaygash, Counsel for State ORDER This Writ Petition has been filed to call for the records pertaining to the impugned patta transfer order dated 21.01.2026 passed by the 3rd respondent in proceedings T.R.2026/26/06/000643SD, to quash the same, and consequently direct the 3rd respondent to restore Patta No. 1007 in favour of the petitioner in respect of the punja land measuring 0.30.20 hectares in Survey No.9/2A2, situated at Kullursandhai Village, Aruppukottai Taluk, Virudhunagar District. 2. Heard the learned counsel appearing for the petitioner and the learned appearing for respondents 1 to 3 / Notice. 2/5 https://www.mhc.tn.gov.in/judis WP(MD). No.19544 of 2026 3. According to the petitioner, the impugned order was passed solely on the basis of the application submitted by the 4th respondent on 23.12.2025. The impugned order came to be passed on 21.01.2026. A reference to the aforesaid dates itself indicates that no notice was issued to the petitioner before passing the impugned order. Admittedly, no enquiry was conducted by the 3rd respondent before effecting the transfer of patta. Therefore, the impugned order has been passed in clear violation of the principles of natural justice. Further, a perusal of the impugned order reveals that it is a cryptic and non-speaking order, as no reasons whatsoever have been assigned by the 3rd respondent for arriving at the conclusion. An order affecting the civil rights of a party cannot be sustained when it has been passed without notice, without enquiry, and without assigning reasons. 4. In view of the above, this Court is inclined to interfere with the impugned order. Accordingly, the impugned order dated 21.01.2026 is quashed, and the matter is remitted to the 3rd respondent/Tahsildar for fresh consideration. No.19544 of 2026 as well as the 4th respondent, afford them adequate opportunity of hearing, conduct a proper enquiry, consider all the relevant documents and submissions made by the parties, and thereafter pass a reasoned order on merits and in accordance with law. The above exercise shall be completed within a period of twelve (12) weeks from the date of receipt of a copy of this order. 5. Accordingly, this Writ Petition is allowed.
