JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused is before this Court in this Criminal revision petition filed under Section 397 read with Section 401 of Cr.PC with a prayer to set aside the judgment and order of conviction and sentence passed in C.C.No.421/2019 dated 17.06.2023 by the Court of Additional Civil Judge and JMFC, T.Narasipura and the judgment and order passed in Crl.A.No.334/2023 by the Court of V Additional District and Sessions Judge, Mysuru dated 29.06.2024. 2. Learned counsel for the petitioner and learned counsel for the respondent jointly submit that dispute between the parties has been amicably settled out of the Court and therefore, this Criminal revision petition may be - 3 - HC-KAR NC: 2026:KHC:5739 CRL.RP No. 1266 of 2024 disposed of setting aside the judgment and order of conviction and sentence passed against him. 3. It is brought to the notice of this Court that respondent has filed a memo before this Court on 13.01.2026 reporting settlement between the parties. 4. The said submission and memo filed on behalf of the respondent on 13.01.2026 is taken on record. 5. The memo filed on 13.01.2026 is signed by the respondent and also by his learned advocate. Considering the aforesaid aspects of the matter, I am of the opinion that the impugned judgment and order of conviction and sentence passed against the petitioner needs to be set aside. Accordingly, the following: ORDER i. The Criminal revision petition is allowed. ii. The impugned judgment and order of conviction and sentence passed by the courts - 4 - HC-KAR NC: 2026:KHC:5739 CRL.RP No. 1266 of 2024 below against the petitioner are set aside and the petitioner is acquitted of the offence punishable under Section 138 of the Negotiable Instruments Act, 1881.
