POONACHA - 3 - HC-KAR NC: 2026:KHC:22771-DB CCC No. 1521 of 2025 ORAL ORDER (PER: HON'BLE MR. VIBHU BAKHRU, CHIEF JUSTICE) 1. The complainant has filed the present complaint alleging wilful disobedience of the order dated 27.01.2025 passed by the learned Single Judge of this Court in W.P.No.1978/2025. 2. In terms of the said order, the interim orders were granted as prayed for till the next date of hearing. This Court is informed that the said interim order is continuing. 3. The complainant had sought the following interim relief: "That, the pending disposal of the above Writ Petition, the petitioner humbly prays that, this Hon'ble court may be pleased to direct the respondent No.5 not to carry any development work in forming the road and drainage in Sy.No.69/2 of Belavadi Village, Elavala hobli, Mysore Taluk and District measuring to an extent of 5 acres 12 guntas till the disposal of this petition in the interest of justice and equity." 4. The accused No.1 (who was arrayed as respondent No.5 in the writ petition) has filed an affidavit affirming that it has not disobeyed the interim order passed by this Court; it has not issued any order for any further development work to be carried on by the contractor. The accused has also enclosed photographs with the affidavit indicating the condition of the road as it was in existence - 4 - HC-KAR NC: 2026:KHC:22771-DB CCC No. 1521 of 2025 prior to the order, disobedience of which is alleged. They confirm that the said photographs which are annexed as annexures-R2(a) to R2(d) were filed on 12.09.2024 in W.P.No.13351/2024. 5. The learned counsel for the complainant does not dispute the same. It is thus evident that the road did exist prior to the order, the disobedience of which is alleged. 6. The accused also states that the complainant had through his henchmen closed the road by dumping construction debris. He also enclosed photographs showing that debris thrown on the road in question. 7. In our view, the complainant cannot take advantage of the ad-interim orders by disturbing the status-quo as it existed on the said day. However, we leave it open for the accused to agitate the said issue before the learned Single Judge. 8. In the given circumstances, we are not persuaded to accept that there is any wilful disobedience of the orders passed by this Court or any proceedings under the Contempt of Courts Act, 1971 are required to be initiated against the accused. - 5 - HC-KAR NC: 2026:KHC:22771-DB CCC No. 1521 of 2025 9.
