The learned Counsel for the applicant submits that the applicant is behind bars since 17.09.2017, however, he has not applied before the trial Court seeking bail on the ground of delay in trial. His last application was rejected in the year 2016, and thereafter, in the year 2023 he got temporary bail for some purpose. In such circumstances, the learned Counsel for the applicant submits that he will move afresh before the trial Court for grant of bail on the ground of delay in trial, and therefore, Rgd. 2026:BHC-NAG:11224 Order 280826ba1093.26 2 seeks permission to withdraw present application. 3. Permission granted. If the applicant files fresh application for grant of bail on the ground of delay in trial, the same shall be decided by the trial Court within a period of two weeks from the date of its filing, since the applicant is behind bars since 17.09.2017.
