Prayer : Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorarified Mandamus, calling for the records relating to the impugned proceedings in Na.Ka.No.5897/2015/A3 dated 30.06.2026 passed by the 3rd respondent, quash the same as illegal, and consequently direct the 1st respondent to dispose of the statutory appeal dated 06.06.2026 preferred by the petitioner under Section 10 of the Tamil Nadu Land Encroachment Act, after affording the petitioner an opportunity of personal hearing, and thereafter consider and pass appropriate orders on the petitioners claim for grant of patta in respect of her Grama Natham property situated in Survey No.824/33, Seethapatti Village, Oddanchatram Taluk, Dindigul District in accordance with law, without interfering with the petitioner's peaceful possession until such exercise is completed. 2.The writ petition has been filed in the nature of a certiorarified mandamus seeking records relating to proceedings dated 30.06.2026 passed by the third respondent/Thasildar, Oddanchatram Taluk, Dindigul District and to direct the first respondent/District Collector, Dindigul District, to dispose of the appeal dated 06.06.2026 filed by the petitioner under Section 10 of the Tamil Nadu Land Encroachment Act, 1905. 3.The petitioner seeks an opportunity of personal hearing to be granted by the first respondent while disposing the appeal under Section 10 of the Act. It is seen from the records that the petitioner had been assigned with the land in Survey No.824/33. It is a Grama Natham property. She had put up her house in the said property, but encroached into a land for which she was not entitled. It is complained that the petitioner had put up a tin shed and that particular portion is an encroachment in an unoccupied Grama Natham land. Notice under Section 7 of the Act was initially issued to the petitioner. Thereafter, an
order was passed under Section 6 of the said Act. Challenging the said order, the petitioner had filed an appeal before the first respondent under Section 10 of the Act. 4.On the side of the respondent, it is contended that the appeal is only a formality and just a one page letter had been forwarded to the District Collector terming it as an appeal. 5.The District Collector may take that particular communication as an appeal under Section 10 of the Act, issue notice to the petitioner and proceed further in the manner known to law and dispose of the same within a period of four weeks from the date of receipt of a copy of this order. Thereafter, let further proceedings be taken in accordance with law. 6.With the above direction, this writ petition stands disposed of. There shall be no order as to costs.
