Petitioner has filed this writ petition seeking following reliefs:- “10.1 That, this Hon’ble Court may kindly be pleased to direct the respondents to remove the anomaly accord in the service of petitioner. 10.2 That, this Hon’ble Court may kindly be pleased to direct the concerned respondents to grant pay scale published in the Gazette dated 14.10.1982 and also direct to pay the arrears to the petitioner from him initial date of appointment. 10.3 That, the Hon’ble Court may kindly be call for the records for its kind perusal which relates to petitioner’s matter. 10.4 That, the Hon’ble Court may kindly be pleased to grant any other relief, as it may deems fit and appropriate.” 2. Learned counsel for petitioner submits that petitioner was engaged as work charged contingency employee in respondent department as Sthal Sahayak which is also known as time keeper. Petitioner thereafter attaining the age of superannuation got retired from service with effect from 31.12.2012 from the post of Field Assistant. Petitioner pursuant to the notification/circular issued by State Govt. is entitled for the equal pay as of Class-III employees. Some of the similarly situated employees have earlier filed a writ petition bearing WPS No. 6355 of 2014 which was disposed of permitting petitioner therein to submit representation to be considered by the concerned authority and therefore, similar order be passed in this writ petition also. She also submits that earlier in another petition bearing WPS No. 2904 of 2005 Dwarikadas Vaishnav and Another Vs. State of Madhya Pradesh 3 / 3 (now Chhattisgarh) has considered the similar issue which was decided on 05.12.2012. 3. Learned counsel for State submits that as petitioner is seeking liberty to submit representation to be decided by competent authority, he is having no objection. 4. On due consideration of submission made by learned counsel for the respective parties, this writ petition at this stage is disposed of permitting petitioner to submit representation before respondent authorities and in the event petitioner submit such representation the concerned authority shall consider and take decision on representation to be submitted by petitioner, in accordance with law, keeping in mind the decision in case of Dwarikadas Vaishnav (supra), and also in case of Laxminarayan Upadhayay Vs. State of M.P. and notification issued in this regard by State of M.P. dated 14.10.1982 as also on 14.10.1992. 5. With the aforesaid observation and direction, this writ petition stands disposed of.
