W.P(MD)No.19606 of 2026 ORDER Assailing the rejection of the petitioner's online application for issuance of a Legal Heir Certificate in Application No. TN-7202604131439 dated 13.04.2026, by the respondent, the present writ petition has been filed. 2.Heard the learned counsel for the parties. 3.By consent of both parties, the Writ Petition is taken up for final disposal at the stage of admission itself. 4. The learned counsel appearing for the petitioner submitted that the petitioner’s father had initially married the elder sister of the petitioner’s mother. Since the first marriage was childless, the petitioner’s father contracted a second marriage with the petitioner’s mother, Selvarani. The petitioner’s mother passed away on 03.11.2013. The petitioner's stepmother Ranjitham passed away on

W.P(MD)No.19606 of 2026 After the demise of their father, the petitioner submitted an application seeking issuance of a Legal Heirship Certificate. However, the application was rejected without assigning any valid reason. Aggrieved thereby, the petitioner has filed the present writ petition. 5. The learned counsel further submitted that G.O.Ms.No.110, dated 13.03.2024, specifically provides that where there is no dispute regarding the legal heirs, the Revenue Authorities are empowered to issue a Legal Heirship Certificate to all the eligible legal heirs. In the present case, the petitioner’s mother and the first wife of the deceased had already passed away, there is no rival claimant and no objection has been raised by any person.
Therefore, the rejection of the petitioner’s application is unsustainable. Accordingly, the petitioner seeks a direction to the respondents to consider the application for issuance of a Legal Heirship Certificate in the light of G.O.Ms.No.110, dated

6. The learned Counsel for the State fairly submitted that the impugned order may be set aside and the matter may be remitted to the respondent for fresh consideration. 7. In view of the aforesaid submission and considering the facts and circumstances of the case, the impugned order is set aside. The matter is remitted to the respondent, who shall consider the petitioner’s application afresh in the light of G.O.Ms.No.110, dated 13.03.2024, after affording an opportunity to all necessary parties and pass appropriate orders on merits and in accordance with law as expeditiously as possible. The writ petition stands disposed of accordingly. There shall be no order as to costs.
