Heard Sri. K. Vijaya Kumar, learned counsel appearing for the petitioners, Sri. Vinay Mahadevaiah, learned High Court Government Pleader appearing for respondent No.1, Sri. Sunil Kumar S., learned counsel appearing for respondent No.2 in Crl.P.No.10108/2025, Sri. G.R. Santhosh, learned counsel appearing for respondent No.2 in Crl.P.No.6774/2023. 3. The petitioners are the accused in the subject petitions and the complainant is the accused in the companion petition. All the parties to the lis are members of the same family are in a squabble with regard to the distribution of property and the entire issue is pending before the Civil Court in O.S.Nos.125/2017 and 81/2023. 4. The learned counsel appearing for the petitioners submits that they would agitate their rights by projecting all the submissions before the Civil Court, one that have been urged in the case at hand, which touch upon the civil case and would consent to quashment of the proceedings in these cases to give a quietus to the criminal proceedings in particular, the - 7 - HC-KAR NC: 2026:KHC:3609 CRL.P No. 10108 of 2025 C/W CRL.P No. 6774 of 2023 proceedings against each other family members stands quashed. 5. For the aforesaid reasons, the following: ORDER (i) Criminal petitions are allowed. (ii) Proceedings in C.C.No.3369/2022 and C.C.No.3397/2022 pending on the file of Principal Civil Judge and JMFC at Nelamangala, stands quashed. (iii) The crimes get obliterated reserving liberty to these petitioners to urge every contention that touch upon the civil cases before the Civil Court at the appropriate stage. Ordered accordingly.
