The present Writ Appeal had been filed challenging the order of the learned Single Judge, dated 02.06.2026 in W.P.(MD)No.14689 of 2026 by which order, the Writ Petition was dismissed. 2.The appellant had challenged the proceedings, dated 15.05.2026, whereby, he had been placed on suspension pending enquiry. Since enquiry is pending, it may not be proper on our part to even state the allegations against the appellant herein. 3.The grievance of the appellant is that the order placing the appellant on suspension is extremely sketchy and no specific details have been given. It had been stated that though he had been placed under suspension on 15.05.2026, disciplinary proceedings had not been initiated. 4.Notice had been directed and counsel for the respondents had also entered appearance. 4.Learned Counsel for the appellant submitted that the statement of the __________ Page2 of 5 https://www.mhc.tn.gov.in/judis WA(MD) No. 961 of 2026 learned Single Judge that the Code of Prevention and Detention of Fraudulent Acts in Tamil Nadu State Marketing Corporation Limited, is conferred on the respondents is not legally sustainable, particularly, because earlier a Division Bench of this Court, in which one of us (R.Sakthivel, J.) was a member, had very specifically stated that TASMAC should not initiate any fresh disciplinary action against any of its employees under the said Code. But however, a perusal of the order impugned in the Writ Petition reveals that it had not been issued under the said Code but on allegations raised against the petitioner. 5.To repeat, we are not entering into any discussion on the allegations. In order to protect and safeguard the appellant, we would place on record the following time line: 1)The petitioner to give a representation to the respondents against the order of suspension on or before 21.07.2026; 2)The respondents to pass order on the said representation on or before 28.07.2026; 3)If the respondents intend to initiate disciplinary proceedings and if they intend to continue to place the petitioner on suspension, then from the date of suspension, they must pay the subsistence allowance in accordance with the Rules; and 4)If the disciplinary proceedings is commenced, the same should be concluded after following due procedure on or before 28.08.2026. __________ Page3 of 5 https://www.mhc.tn.gov.in/judis WA(MD) No. 961 of 2026 6.It is hoped that the appellant would participate in the disciplinary proceedings and cooperate and ensure that the time lines are kept up. The respondents are under obligation to adhere to the time lines stipulated by the Court. 7.With the above observations, the Writ Appeal stands dismissed. No costs.
